A meeting of the cabinet of Haryana state was held with the CM Manohar Lal Khattar as its head and the government has given a green flag to the proposal demanding the formation of a law that will grant death penalty to the culprits for raping girls that are 12 years or less in age. The cabinet agreed to make the laws against sexual assault more severe.
The cabinet is also making provisions to change the existing laws of Indian Penal Code like 376D (rape by one person or a group), 354 D(2) (stalking), 376A (Intercourse by man and wife while they are separate) and 354 (sexual assault on a woman with an intent to harm her dignity).
If a girl of age 12 or less is raped by a single person or a group, then each individual will face the death penalty or will be sentenced to jail for 14 years or more and might also get life imprisonment. The section 376D A of IPC was amended to include a provision that states if a girl of 12 years or less is raped by an individual or a group, then each person of the group will be guilty of rape and will be either sentenced to death or a jail sentence of 20 years or more and the sentence can be extended for entire life of the culprits in addition to charging a fine.
The fine imposed in this case should be sufficient to cover the medical cost and recover the victim. The fine amount charged to the guilty will be paid entirely to the victim. As per the proposal which was accepted, the penalty under section 354 will be 2 years or more and it can also be extended to 7 years and can be subject to fine.
